• Account — a unique account created for You to access the Service.
• Company ("We", "Us", "Our") — Hay VL.
• Content — images and other material You upload to or generate through the Service.
• Credits ("XU") — the virtual units used to generate images through the Service.
• Device — any device that can access the Service, such as a computer or mobile device.
• Service — the Website.
• Website — Hay VL, accessible at https://hayvl.app/
• You — the individual or entity accessing the Service.

2. Acceptance of Terms

By accessing or using the Service, You agree to be bound by these Terms and by Our Privacy Policy. If You disagree with any part of these Terms, You may not access or use the Service.

3. Eligibility and Accounts

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the confidentiality of Your Account credentials and for all activity that occurs under Your Account.
• You agree to provide accurate information and to notify Us promptly of any unauthorized use of Your Account.

4. Credits, Payments and Refunds

• The Service is credit-based. Credits ("XU") are required to generate images, and the number of Credits needed depends on the selected mode and provider.
• New users may receive free Credits upon registration.
• You may purchase Credits through Our payment partner. Credit packages, prices (in VND), and the price per Credit are shown on the Pricing page and may change at any time.
• Credits are consumed only when a generation is completed successfully. If a generation fails, no Credits are deducted.
• Credits are non-transferable, have no cash value, and are non-refundable, except where required by law.
• Payments are processed by a third-party payment provider; We do not store Your full payment details.

5. User Content and Images

• You retain ownership of the images You upload and, subject to applicable law, of the images You generate.
• By uploading Content, You grant Us a limited license to store, process, and transmit it solely to operate the Service.
• You represent that You own or have the necessary rights to the Content You upload, and that it does not infringe any third party's rights.
• Uploaded and generated images are stored temporarily and are automatically and permanently deleted after several days. For the exact retention period, please see the notice on the Profile/History page. Please download any images You wish to keep before they are deleted.
• We are not responsible for any loss of Content that is deleted in accordance with this Policy.

6. Acceptable Use

You agree not to use the Service to upload, generate, or share Content that:

• is illegal, harmful, threatening, abusive, defamatory, or obscene;
• infringes any copyright, trademark, or other proprietary right;
• depicts minors in a sexual or harmful manner, or is non-consensual, including deepfakes or impersonation;
• contains viruses, malware, or other harmful code;
• otherwise violates any applicable law.

We may remove Content and suspend or terminate Accounts that violate these rules.

7. AI-Generated Content

Images generated by the Service are produced by artificial intelligence and may be inaccurate, unexpected, or similar to other outputs. You are solely responsible for how You use generated Content and for ensuring that Your use complies with applicable law.

8. Third-Party Links and Services

Our Service may contain links to, or rely on, third-party websites or services that are not owned or controlled by the Company. We have no control over, and assume no responsibility for, their content, privacy policies, or practices. We strongly advise You to review the terms and privacy policies of any third-party service You use.

9. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service will cease immediately, and any remaining Credits are forfeited, except where required by law.

10. Disclaimer ("AS IS" and "AS AVAILABLE")

The Service is provided "AS IS" and "AS AVAILABLE", with all faults and defects, and without warranty of any kind. To the maximum extent permitted by applicable law, We disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet Your requirements, operate without interruption, or be error-free, or that any errors will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the entire liability of the Company shall be limited to the amount actually paid by You through the Service, or if You have not purchased anything through the Service. In no event shall the Company be liable for any special, incidental, indirect, or consequential damages whatsoever, including loss of profits, loss of data, or business interruption, arising out of or in any way related to Your use of, or inability to use, the Service.

12. Governing Law and Disputes

These Terms are governed by the laws of Vietnam, excluding its conflict-of-law rules. If You have any concern or dispute about the Service, You agree to first try to resolve it informally by contacting the Company.

13. Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice before it takes effect. By continuing to use the Service after revisions become effective, You agree to be bound by the revised Terms.
